Section 117: Security for good behavior from suspected persons

When can this be applied?

If a person:

Has previously been convicted of a non-bailable offence, or

Has been charged with such an offence, or

Is suspected to behave in a way that causes harm or annoyance to others,

The Magistrate can require the person to furnish security for maintaining good behavior for a specified period (usually up to 1 year).

Purpose:

To prevent the person from repeating unlawful or harmful conduct.

To maintain public order and safety.

To protect potential victims from further harm.

Procedure:

The Magistrate issues a notice to the person.

After inquiry, if the Magistrate is satisfied, the person is ordered to provide security (bond) with or without sureties.

Failure to give security can result in further legal action.

Example:

If a person has repeatedly caused disturbances or threatened neighbors, the Magistrate may order them to provide security for good behavior to ensure peace is maintained.
