The Bombay High Court recently overturned the conviction of a man accused of raping his minor daughter, citing insufficient evidence. This decision has triggered strong reactions, with some calling it a victory for fair trials and others questioning the effectiveness of the justice system in handling sensitive cases.
The case revolved around allegations that the man had sexually assaulted his daughter over a period of time. However, during the trial, inconsistencies emerged in the testimony of the victim and other witnesses. The defenseargued that the case was built on weak evidence and circumstantial allegations.
The High Court, in its ruling, emphasized that a conviction cannot be based on doubt and that the prosecution had failed to establish guilt beyond reasonable doubt. “Justice must be based on proof, not speculation,” the judgment stated.
Women’s rights groups have expressed concern over the verdict, arguing that it sets a worrying precedent for cases of sexual violence. Legal experts, however, caution against jumping to conclusions, emphasizing that the principles of due process must be upheld even in emotionally charged cases.
While the man walks free, the case has reignited discussions about how the Indian legal system balances the rights of the accused with the need to deliver justice in crimes against women and children
