IPC Section 213: Causing a Magistrate to frame an incorrect sentence

Text of Section 213:

"Whoever, by doing any act or knowingly omitting to do any act which it is his duty to do, causes any Magistrate to frame an incorrect sentence or order in any stage of a judicial proceeding, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both."

This section applies when a person causes a Magistrate to pass a wrong or incorrect sentence or order.

It can happen by:

Doing some act, or

Knowingly omitting to do some act which they are legally bound to perform.

The act or omission must happen during any stage of a judicial proceeding.

The key is that the person’s actions lead to the Magistrate’s incorrect decision.

⚖️ Punishment:

Imprisonment for up to 2 years, or

Fine, or

Both imprisonment and fine.

🧑‍⚖️ Example:

If a party in a court case deliberately withholds evidence or misleads the Magistrate resulting in an unfair sentence or order, they can be charged under Section 213 IPC.
