CrPC Section 400

Section 400 of the Criminal Procedure Code (CrPC), 1973:

📜 Section 400 CrPC – Additional Sessions Judge to try cases made over to him

📠Key Provision:

An Additional Sessions Judge has the authority to try any case or hear any appeal which the Sessions Judge makes over to him for trial or disposal.

🔠Explanation:

The Sessions Judge (head of the Sessions Court) can assign or delegate cases or appeals to any Additional Sessions Judge under his jurisdiction.

This delegation is done to ensure efficient distribution of workload in the Sessions Court.

Once the case is made over, the Additional Sessions Judge has full power to conduct the trial or hear the appeal just like the Sessions Judge.

Ensures speedy and effective administration of justice.

Provides flexibility in managing high volumes of criminal cases.

✅ Example:

If a Sessions Court in a district is overloaded with criminal appeals and trials, the Sessions Judge may assign some of these cases to an Additional Sessions Judge to maintain efficiency and avoid delays.
