Section 8 of the Probation of Offenders Act, 1958 deals with the power of the Court to revoke probation.
Summary of Section 8 - Probation of Offenders Act, 1958:
If a person who has been released on probation or on conditions under this Act commits any offence during the period of probation or breaches any conditions of the probation, the court may revoke the probation.
Upon revoking probation, the court can pass any sentence which it could have originally passed on the offender.
The revocation can be done after giving the offender a reasonable opportunity to be heard.
In brief:
Section 8 empowers the court to cancel the probation granted to an offender if they violate conditions or commit another offence during the probation period, and impose the original sentence.
