Remedies under Tort Law
Remedies for Trespass to Land
When someone unlawfully enters or interferes with your land, the law provides several remedies to protect your rights and compensate for any harm.
1. Injunctive Relief (Injunction)
A court may issue an injunction to prevent the trespasser from entering or continuing to trespass on the land.
Injunctions can be:
Temporary (Interim): To stop ongoing or imminent trespass before a full trial.
Permanent: Issued after the case is decided, preventing future trespass.
2. Damages (Compensation)
The trespasser may be ordered to pay damages for:
Any actual harm or loss caused by the trespass.
Nominal damages even if no physical harm occurred (because trespass is a tort actionable per se).
Exemplary (punitive) damages in cases of malicious trespass.
3. Self-Help
In some jurisdictions, a landowner may use reasonable force to remove trespassers.
This is limited to avoid breach of peace or criminal liability.
Usually advisable to seek legal remedies first.
4. Other Remedies
Ejectment: Legal process to recover possession of the land.
Criminal Action: In some cases, trespass can also attract criminal liability under laws like Section 441-447 of the Indian Penal Code.
