APPLICATION FOR CONDONATION OF DELAY IN FILING THE SPECIAL LEAVE PETITION

The Petition of the Petitioner most respectfully showeth:
1. That the Petitioner is preferring this petition under Article 136 of Constitution of India for grant of Special Leave to Appeal against the Impugned Order dated 24.10.2021 passed by the Hon’ble High Court of Madras, Madurai Bench in Second Appeal (MD) No.737 of 2021 and in CMP No. 29 and 864 of 2019, whereby by the Hon’ble High Court of Madras, Madurai Bench has been pleased to dismissed the second appeal as abated and dismissed the C.M.P (MD) filed by the Petition.
2. That the petitioner is not repeating the detailed facts and pleadings which have been stated in the Special Leave Petition and hence are not being repeated herein for the sake of brevity.
3. It is stated that there is a delay of days in filing the Special Leave Petition against order dated 24.10.2020 passed by by the Hon’ble High Court of Madras, Madurai Bench in Second Appeal (MD) No.37 of 2005 and in CMP No. 92 and 164 of 2019. The petitioner counsel could not receive the complete details facts of the case along with some essential documents which is necessary for the Petition The delay is only on account of the said fact.
4. The delay is neither willful nor deliberate but is bonafide for reasons stated above.
5. That the petitioner have very a good case on merits and unless delay in Filing is condoned and heard on merits petitioner would be put to great loss and hardship.
PRAYER:
For the reasons stated above the petitioner above named most respectfully prays that this Hon’ble Court be pleased to:
a) Condone the delay of days in filing the Special leave Petition against Final Impugned Judgment dated 24.10.2019 passed by by the Hon’ble High Court of Madras, Madurai Bench in Second Appeal (MD) No.73 of 2005 and in CMP No. 92 and 864 of 2019.
b) Pass such further order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.
AND FOR THIS ACT OF KINDNESS THE PETITIONER AS IN DUTY BOUND SHALL EVER PRAY.
