Supreme Court Aruba (Netherlands)

Aruba, as a constituent country of the Kingdom of the Netherlands, does not maintain a separate Supreme Court. Instead, its highest judicial authority is the Joint Court of Justice of Aruba, Curaçao, and Sint Maarten, which serves as the final appellate court for these territories. This court is based in Curaçao and handles appeals in civil, criminal, and administrative matters.

Recent Developments:

Legalization of Same-Sex Marriage: On July 12, 2024, the Supreme Court of the Netherlands ruled that bans on same-sex marriage in Aruba and Curaçao were discriminatory. This decision effectively legalized same-sex marriages in these territories.

Recognition of Registered Partnerships: Prior to the legalization of same-sex marriage, Aruba recognized registered partnerships for both same-sex and opposite-sex couples starting in September 2021.

These developments reflect Aruba's integration within the Dutch legal framework and its adherence to rulings from the Kingdom's highest courts.
