⚖️ Judicial Structure and Judgment Review

1. Supreme Court

The Supreme Court is the highest court in The Gambia and serves as both the court of cassation and the court of constitutional review. It reviews court judgments through cassation proceedings and hears petitions for constitutional review. The Court is composed of the Chief Justice and at least four other Justices. The Supreme Court has the authority to overrule its previous decisions when it appears right to do so, and all other courts are bound to follow its decisions on matters of law.

2. Court of Appeal

The Court of Appeal hears and determines appeals from judgments, decrees, and orders of the High Court, and has appellate jurisdiction as conferred by law. An appeal lies as of right to the Court of Appeal from any judgment, decree, or order of the High Court. The Court is constituted by the President of the Court of Appeal, not less than three Justices, and may include a selected High Court Judge for a particular matter. 

3. High Court

The High Court has appellate jurisdiction to hear appeals from subordinate courts, including Magistrates' Courts, District Tribunals, and other lower courts. It also has supervisory jurisdiction over lower courts to make orders, issue directions, and write orders of habeas corpus, mandamus, certiorari, and prohibition. The High Court is the first instance for most legal matters and serves as the appellate body for decisions from lower courts.
