Civil Law And UAE Electronic Evidence And Digital Proof
1. Introduction
Electronic evidence has become a central component of civil and commercial litigation in the UAE.
Modern disputes frequently depend upon:
emails;
WhatsApp messages;
SMS messages;
electronic contracts;
digital signatures;
bank transaction records;
electronic invoices;
cloud records;
website records;
computer files;
CCTV and video;
metadata;
GPS information;
platform records;
blockchain records;
electronic payment records; and
electronically generated business records.
The UAE legal system has responded by giving electronic evidence a recognised legal status.
The principal federal legislation is Federal Decree-Law No. 35 of 2022 on Evidence in Civil and Commercial Transactions. Article 53 defines electronic evidence as evidence derived from data or information generated, stored, extracted, copied, transmitted, reported or received through information technology and retrievable in an understandable form.
The subject should therefore be understood through three connected concepts:
Electronic record → Digital authentication → Judicial proof
An electronic document is not merely a substitute for paper. It can independently establish facts where its authenticity, integrity, attribution and reliability are sufficiently demonstrated.
2. Meaning of Electronic Evidence

3. Federal Definition of Electronic Evidence
Article 53 of the UAE Evidence Law provides a technologically broad definition.
Electronic evidence includes evidence derived from information generated, stored, extracted, copied, transmitted, reported or received through information technology and capable of being retrieved in an understandable manner.
This is important because the law does not restrict electronic evidence to a particular device or technology.
Consequently, the concept can accommodate new technologies as they develop.
The underlying principle is:
The legal system regulates the evidentiary function of digital information rather than merely naming particular technologies.
4. Types of Electronic Evidence
The federal Evidence Law recognises multiple forms of electronic evidence.
They include, among other things:
electronic records;
electronic documents;
electronic signatures;
electronic correspondence;
