Alabama Constitution Section 87 - Deductions from salaries or compensation of public officers for neglect of duty.

Alabama Constitution – Section 87: Deductions from salaries or compensation of public officers for neglect of duty

This section states:

"The salaries or compensation of any officer shall not be increased or diminished during the term for which he shall have been elected or appointed; and no such officer shall receive from the state any other compensation than that fixed by law for his services. But this shall not be construed to prevent the legislature from deducting from any officer's salary or compensation any amount for neglect of duty."

Key Points:

Fixed Compensation: Public officers’ salaries cannot be changed (increased or decreased) during their term.

No Additional Pay: Officers cannot receive any extra pay from the state outside what is set by law.

Neglect of Duty Penalty: However, the legislature can reduce an officer's pay as a penalty if they neglect their duties.

Purpose:

This section aims to:

Maintain fairness by keeping officer salaries stable during a term.

Prevent corruption by banning unauthorized compensation.

Encourage accountability by allowing penalties for misconduct or negligence.
