Alabama Constitution Section 58 - Adjournment or change of place of sitting by one house without consent of other house.

Alabama Constitution – Section 58: Adjournment or Change of Place of Sitting by One House Without Consent of the Other House

Text of Section 58:

“Neither house shall, without the consent of the other, adjourn for more than three days, nor to any other place than that in which they may be sitting.”

Explanation:

Section 58 of the Alabama Constitution addresses how the House of Representatives and the Senate (the two chambers of the Alabama Legislature) operate in relation to each other when it comes to adjournment and location of meetings.

It sets two clear rules:

No Adjournment Over 3 Days Without Consent:

One chamber cannot adjourn for more than three days unless the other chamber consents.

This ensures legislative continuity and cooperation between both houses.

No Change of Meeting Location Without Consent:

Neither chamber can move its meetings to a different location (outside of where the Legislature is officially sitting) without the consent of the other.

Purpose:

To promote coordination and balance between the House and Senate.

To prevent one house from acting unilaterally in ways that could disrupt the legislative process.

To maintain the integrity and order of the legislative system.
