Alabama Constitution Section 161 Failure of judges or chancellors to attend regular terms of court
Here is the text of Section 161 of the Alabama Constitution:
Section 161 – Failure of judges or chancellors to attend regular terms of court.
If any judge or chancellor fails to attend a regular term of any court, which by law he should attend, and the condition of the court and the amount and character of the business require his attendance, it shall be the duty of the governor to appoint some one learned in the law to hold the court during the absence of the judge or chancellor.
Key Points:
Judicial Absence: If a judge or chancellor fails to attend a scheduled term of court they are legally obligated to attend…
Business Requirement: …and the court's business requires a presiding judge or chancellor…
Governor's Duty: …then the Governor is required to appoint a qualified person (someone "learned in the law") to temporarily preside over the court.
This ensures that the judicial process is not stalled due to a judge’s absence.
